The biggest problem with commercial litigation is the clients' feelings of lack of control, both in terms of what might happen during the process and in terms of the cost associated with litigation. For example, corporate counsel just found out that they got sued for breach of contract. They received a Complaint, they received the Summons, they need to file an Answer as soon as possible so that they are not to be found in default.
